Do I need to preserve iMessages for legal discovery?

Yes, if you're involved in litigation or reasonably anticipate legal proceedings. Federal Rules of Civil Procedure in the United States require parties to preserve and produce electronically stored information (ESI) relevant to litigation, including text messages and chat communications, regardless of platform.

Legal Hold Requirements

When litigation is reasonably anticipated, parties have a duty to preserve relevant evidence. This obligation begins before formal discovery requests—it starts when you know or should know that litigation is likely. For iMessages, this means you must prevent deletion of relevant conversations and implement preservation procedures. Courts have consistently rejected "technical difficulty" as a defense for failing to produce mobile messages.

Spoliation Risks

Spoliation refers to the destruction of evidence after a duty to preserve has arisen. With iMessages, spoliation is particularly risky because users can delete individual messages or entire conversations with a few taps. If "Messages in iCloud" is enabled, deletions sync across all devices and eventually remove data from cloud storage. Courts have imposed significant sanctions for iMessage-related discovery failures, including adverse inferences (juries are instructed to assume missing messages would have been unfavorable), monetary sanctions, and even case dismissals.

Device-Centric Storage Challenges

Because iMessages are primarily stored on individual devices rather than centrally managed servers, legal holds require preserving the physical devices themselves—often personal iPhones in BYOD (Bring Your Own Device) scenarios. This creates practical complications when employees need their devices for daily use while preserving them as evidence.

Proactive Export Strategy

To address these challenges, consider implementing a proactive export strategy. When you become aware of potential litigation, immediately export relevant iMessage conversations using tools like TextKeep. Store the exports in a secure location separate from the device. This creates a defensible preservation record and reduces reliance on maintaining physical device access throughout lengthy litigation. For ongoing matters, establish regular export schedules to capture new messages as they occur.

Consult Legal Counsel

Message preservation requirements vary by jurisdiction and case specifics. If you're facing potential litigation, consult with an attorney about your specific preservation obligations. They can advise on appropriate legal hold procedures, export formats that meet discovery requirements, and defensible strategies for managing electronic evidence.
